Terms & Conditions

These Terms & Conditions (“Terms”) govern the services provided by Simple Site Hero, a service of Solarsilk Interactive, Inc., located at 44 Greenmeadow Road, Pleasantville, NY 10570 (“we,” “us,” or “our”). By purchasing, subscribing, or using our services, you (“you,” “your,” or “Client”) agree to these Terms.

1. Our Service

Simple Site Hero provides done-for-you website design, hosting, and ongoing support for small businesses.

Each client receives:

  • Custom setup and design of their website

  • Secure hosting on our servers

  • Ongoing maintenance, software updates, and technical support

Our services are provided under your own domain name, which you own and control.

2. Fees and Billing

  • Setup Fee: A one-time, non-refundable fee of $249 is charged when you order your website design.

  • Monthly Subscription: A recurring fee of $49 per month, billed automatically via Stripe.

  • Refunds: Monthly fees are refundable on a pro-rated basis if you cancel mid-month. The setup fee is non-refundable.

  • Failed Payments: If a payment fails (e.g., expired card), we’ll notify you and allow a 15-day grace period. After 15 days, your subscription will be cancelled and your site will go offline. Reactivating your subscription will bring your site back online.

3. What’s Included

Your monthly plan includes:

  • Hosting, maintenance, and security updates

  • Full access to your Simple Site Hero dashboard

  • Site content and minor design updates, up to 30 minutes of work and 3 separate requests per monthly billing period.

Additional updates beyond these limits will be discussed in advance and billed at $50 per hour with a 30-minute minimum charge of $25.

4. Ownership of Content and Platform

  • You retain ownership of your content, including all text, images, and logos that you provided to us.

  • We retain ownership of the Simple Site Hero platform, design templates, and all underlying code used to build or host your site.

  • Your site is hosted and managed entirely on our system and cannot be transferred to another hosting provider.

  • Upon cancellation, at your request, we will provide a PDF export of each page containing all text and images that you provided to us. We will not provide standalone or editable files of any third-party licensed assets (such as stock images, AI-generated images, icons, or illustrations) that were supplied by us under license and used on your site.

5. Website Access and Maintenance

We may access your website or account to perform updates, troubleshooting, or maintenance.
We make reasonable efforts to keep all hosted websites available at all times, and our hosting infrastructure historically maintains uptime exceeding 99%. However, we do not guarantee uninterrupted or error-free operation, and temporary interruptions may occur for maintenance, upgrades, or network issues beyond our control.

6. Client Responsibilities

You are responsible for:

  • The accuracy and legality of all content you provide

  • Maintaining ownership and renewal of your domain name

  • Keeping your payment information current

You agree not to use your website for unlawful purposes or to distribute malicious, harmful, or infringing content.

7. Cancellation

You may cancel at any time by emailing support@simplesitehero.com or through your dashboard.
Upon cancellation:

  • Your subscription will end at the end of the current billing cycle.

  • Your site will go offline.

  • We will retain your data for up to 60 days, after which it may be permanently deleted.

8. Communication and Updates

By creating an account, you agree that we may send you:

  • Transactional emails about your website and billing

  • Occasional product updates or feature announcements
    You can unsubscribe from promotional emails at any time.

9. Custom Code and Third-Party Tools

We may, at our discretion, include client-provided custom code or third-party embed scripts on your site.
We are not responsible for the operation, security, or compatibility of such code.

10. Referral Program

We may offer a referral or affiliate program. Participation in that program is optional and governed by its own Referral Program Terms, available separately.

11. Limitation of Liability

To the fullest extent permitted by law, Simple Site Hero and Solarsilk Interactive, Inc. are not liable for any indirect, incidental, or consequential damages, including loss of profits, business interruption, or data loss, arising from your use of our services.
Our total liability will never exceed the total fees paid by you to us during the preceding 12-month period.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • The content you publish on your website, or

  • Your violation of these Terms or any applicable law.

13. Refusal of Service and Content Standards

We reserve the right to refuse to create, host, or maintain any website or content that we deem, at our sole discretion, to be illegal, offensive, misleading, or inconsistent with our brand values or community standards.
This includes (but is not limited to) content that promotes hate, violence, harassment, discrimination, adult or sexually explicit material, or deceptive business practices.
If such content is discovered after a project begins, we may suspend or terminate the site and refund any prorated unused fees at our discretion.

14. Termination by Us

We reserve the right to suspend or terminate your account or site at any time if:

  • You violate these Terms,

  • Your payment fails and is not resolved within the grace period, or

  • Your content violates laws or our acceptable-use standards.

15. Changes to These Terms

We may update these Terms periodically. Updates will be posted on this page, and the “Effective Date” will be revised accordingly. Continuing to use our services after any change constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.
